Hygicare Ltd Conditions of Sale which Apply:
Unless otherwise stated in writing by Hygicare Ltd, all quotations and contracts for the supply of products and goods (‘goods’) by Hygicare Ltd are made using these Terms and Conditions of Sale set out below, which will override any terms and conditions which the purchaser of such goods imposes or tries to impose whether before or after the receipt by such purchaser of the conditions.
Orders and delivery of goods assumes that the conditions have been accepted.
Any Variation to the conditions must be approved by Hygicare Ltd in writing. All quotations and estimates are subject to the Conditions listed below.
A. Hygicare Ltd Website Orders
Apply only to the UK
Orders will only be accepted if made by the credit card holder. No third party orders unless previously agreed with Hygicare Ltd prior to sale.
Deliveries will be made to the credit card holder’s address only, unless otherwise agreed with Hygicare Ltd prior to sale.
Hygicare Ltd reserves the right to make part deliveries, which does not give the purchaser the right to terminate the order.
Claims for short or damage to goods should be made within 24 hours of delivery.
Items returned which are not faulty may result in a charge to the purchaser of 20%.
Hygicare Ltd has the right to charge carriage where applicable.
B. Hygicare Ltd Prices:
All prices are subject to VAT where applicable.
Price lists are correct at the time of printing.
Prices are subject to change without notice.
Prices charged will be the price at the time of ordering.
C. Retention of Title:
All goods are at the risk of the purchaser on delivery, but legal title does not pass to the purchaser until Hygicare Ltd has received cleared funds for the goods, and any outstanding monies at that time.
All goods will be properly protected, insured and stored for Hygicare Ltd, until legal title is transferred.
The right to re-sell or use the goods by the purchaser terminates automatically if events listed in note I (Termination of Contract) occur.
Until legal title passes to the purchaser, Hygicare Ltd may require the return of goods or repossess the goods from the premises of the purchaser.
D. Hygicare Ltd Net monthly payment terms:
If payment terms are not met, Hygicare Ltd is entitled to stop any outstanding orders, supply or quotation, and has the right to receive payment of all monies owed.
Hygicare Ltd will be entitled to charge the purchaser interest on the amount unpaid until full payment is made, and the purchaser will cover all costs incurred by Hygicare Ltd in recovering payment, including solicitor costs, and bank charges for retuned cheques.
Payments are not regarded as received until the funds have cleared in Hygicare Ltd’s account.
E. Quality:
For goods which are shown to Hygicare Ltd to have faults, Hygicare Ltd will either replace the goods, or issue a credit note to the value of the faulty goods.
Expenses of replacement will be met by Hygicare Ltd.
However, Hygicare Ltd will not be held liable for goods which are deliberately damaged, or have not been stored correctly, or if manufacturer instructions have not been followed.
F. Liability
Hygicare Ltd will not be held liable for any economic losses incurred through the use of goods supplied by Hygicare Ltd.
G. Safety
The purchaser will comply with the written instructions as set out by the manufacturer of goods supplied by Hygicare Ltd.
It is the responsibility of the purchaser to ensure all health and safety information required for goods is obtained.
H. Termination of a contract:
Hygicare Ltd may cancel a contract or delivery of goods without liability if the purchaser breaches obligations under the Conditions of Sale listed above, or ceases to do business, or if a lender moves to posses the property/ goods it has for security of the purchaser.
I. product Information
Hygicare Ltd will ensure to the best of its knowledge that all product information is accurate.
It is the responsibility of the purchaser to check details which they wish to rely on.
J. Data Protection:
Hygicare Ltd will comply with all obligations under the Data protection Act 1988.

No information in the catalogue, on-line or other Hygicare Ltd advertising media can be produced without written consent from Hygicare Ltd, unless such information is in the public domain.
